Broker agrees to arrange for the transportation of Shipper’s vehicle with a licensed and insured Carrier. All transportation services are performed by the Carrier. ⸻ 1. QUOTES & PRICING All quotes are based on current market conditions and the accuracy of the information provided by Shipper. Final price may change if: * Vehicle condition differs (e.g., inoperable vs operable) * Vehicle size/weight is inaccurate * Locations or dates change * Market conditions fluctuate ⸻ 2. PAYMENT TERMS A deposit is required to initiate service. The remaining balance is paid to the Carrier at delivery unless otherwise agreed. Deposits are non-refundable once a Carrier is assigned, except as stated in cancellation terms. ⸻ 3. PICKUP & DELIVERY Pickup and delivery dates are estimates only and not guaranteed. Delays may occur due to weather, road conditions, mechanical issues, or other unforeseen factors. Shipper agrees to be available (or assign a representative) at both pickup and delivery. ⸻ 4. VEHICLE CONDITION Shipper must provide accurate vehicle condition details. The vehicle must be in safe operating condition unless declared inoperable. Carrier may refuse transport if the vehicle is unsafe or misrepresented. ⸻ 5. PERSONAL ITEMS Shipper agrees not to place personal belongings in the vehicle unless explicitly approved. Any items left in the vehicle are at Shipper’s sole risk, and neither Broker nor Carrier is liable for loss or damage. ⸻ 6. INSPECTION & BILL OF LADING Vehicle condition will be documented at pickup and delivery via a Bill of Lading. Shipper or their representative must: * Inspect the vehicle upon delivery * Note any damage at that time Failure to note damage may result in denial of claims. ⸻ 7. INSURANCE & CLAIMS The Carrier maintains cargo insurance during transport. Insurance coverage starts minimum from $150000 to $250000. All damage claims must be filed directly with the Carrier. Broker may assist but bears no liability for claims, damages, or disputes. ⸻ 8. CANCELLATION POLICY * Cancellation before Carrier assignment: full refund of deposit * Cancellation after Carrier assignment: deposits are not refundable * If Carrier fails to pick up within agreed timeframe: Shipper may cancel without penalty ⸻ 9. STORAGE & ADDITIONAL FEES Additional charges may apply for: * Storage fees * Redelivery attempts * Inoperable vehicles not disclosed * Changes in pickup/delivery details * Waiting time or detention ⸻ 10. LIMITATION OF LIABILITY Broker shall not be liable for: * Carrier performance or negligence * Vehicle damage, delay, or loss * Personal items inside the vehicle * Mechanical issues or pre-existing damage * Acts of God, including weather and natural disasters Broker’s total liability is limited to the amount of the deposit paid. ⸻ 11. INDEMNIFICATION Shipper agrees to indemnify and hold Broker harmless from any claims, damages, or costs arising from: * Inaccurate information provided by Shipper * Personal items in the vehicle * Violations of laws or regulations ⸻ 12. FORCE MAJEURE Broker shall not be liable for failure or delay caused by events beyond reasonable control, including but not limited to natural disasters, war, strikes, or government actions. ⸻ 13. DISPUTE RESOLUTION Any disputes arising under this Agreement shall first be resolved through good faith negotiation. If unresolved, disputes shall be settled through binding arbitration in the agreed jurisdiction under applicable laws. ⸻ 14. GOVERNING LAW This Agreement shall be governed by and construed in accordance with the laws of the applicable jurisdiction stated in the service agreement. ⸻ 15. ENTIRE AGREEMENT These Terms & Conditions constitute the entire agreement between the Parties and supersede all prior discussions, representations, or agreements. ⸻ 16. SEVERABILITY If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect. ⸻ 17. ELECTRONIC CONSENT Electronic signatures, approvals, or confirmations shall be deemed legally binding and enforceable.
